Terms of Service

1. Acceptance of These Terms

These Terms of Service (the "Terms") are a binding agreement between you and Dialed Health ("Dialed Health," "we," "us," or "our") and govern your use of our website at app.dialed-health.org, our mobile applications, and related services (collectively, the "Services"). By using the Services you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. Some events or groups may impose additional age restrictions (such as 21+ for alcohol-related events). You are responsible for complying with all applicable laws in your jurisdiction.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@dialed-health.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • Violate any applicable law or regulation.
  • Post content that is unlawful, harassing, fraudulent, or infringes the rights of others.
  • Attempt to gain unauthorized access to the Services or any related systems, networks, or accounts.
  • Interfere with the operation of the Services or place an unreasonable load on our infrastructure.
  • Use the Services to send unsolicited bulk messages or otherwise abuse our SMS or email features.

5. Events, RSVPs, and Tickets

Events are organized by individual hosts or partners. Dialed Health provides the platform but is not the organizer of every event listed. Hosts are responsible for their event content, scheduling, and conduct. Refund and cancellation policies are set by the host of each paid event; contact the host or your payment provider for refund requests.

6. Groups

Some groups are open to the public; others require host approval ("private groups"). By joining a group you agree to follow that group's rules and conduct expectations. You may leave a group at any time from the group page.

7. Payments

Paid tickets and any other purchases are processed by Stripe. By making a purchase you agree to Stripe's terms. Dialed Health is not responsible for issues caused by your payment method or your card issuer.

8. SMS Messaging Program Terms

By providing your mobile number and checking the SMS opt-in box on the Services, you consent to receive recurring, automated text messages from Dialed Health at the number you provided. Consent is not a condition of purchase.

Program description

Dialed Health operates the "Dialed Health SMS" messaging program. Messages may include event reminders, RSVP and ticket confirmations, group updates, and account notifications.

Message frequency

Message frequency varies. Most users receive 2–4 messages per month.

Msg & data rates may apply.

Opting out — STOP

You can cancel the SMS service at any time. Reply STOP to any message we send. After you reply STOP we will send you one final message confirming you have been unsubscribed. After that, you will no longer receive SMS messages from us. To rejoin, sign up again as you did the first time and we will resume sending messages to you.

Help — HELP

If at any time you forget what keywords are supported, reply HELP to any message and we will respond with instructions, our contact info, and a link to this page. You can also email us at support@dialed-health.com.

Supported carriers

All major US carriers (AT&T, Verizon, T-Mobile, U.S. Cellular, etc.)

Carrier liability

Carriers are not liable for delayed or undelivered messages.

Privacy

Mobile information you provide for SMS — including your phone number, consent, and the contents of messages we send — is handled as described in our Privacy Policy. We do not share mobile opt-in or consent data with any third party for marketing or promotional purposes.

9. Intellectual Property

The Services and all content provided by Dialed Health, including software, designs, logos, and text, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, or redistribute the Services except as permitted by these Terms.

10. User Content

You retain ownership of content you submit to the Services (such as group posts or photos). You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as necessary to operate the Services. You represent that you have the rights necessary to grant that license.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Dialed Health does not warrant that the Services will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Dialed Health and its officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or related to your use of the Services. Our aggregate liability for any claim arising out of or related to the Services will not exceed the greater of (a) the amounts you paid to us in the twelve months preceding the claim, or (b) $100.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the "Effective" date above. By continuing to use the Services after changes take effect you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Disputes will be resolved exclusively in the state or federal courts located in Los Angeles County, California, unless otherwise required by applicable law.
